The 5x Identified Opportunity Guarantee (as defined in the Terms of Service Section 4A) is a guarantee that the Platform will identify estimated opportunities of a stated magnitude; it is not a guarantee that any savings will be realized, captured, or achieved. "Identified" savings are estimates applied to your self-reported spend, as further described on our Guarantee page and in Terms of Service Section 4A. 3. SOLE RESPONSIBILITY By using this Platform, you acknowledge and agree that your organization is solely responsible for: a) Determining the clinical appropriateness of any product substitution or standardization b) Ensuring legal and regulatory compliance of all procurement decisions c) Evaluating the operational feasibility of recommended changes d) Conducting due diligence on vendors and contract terms e) Obtaining necessary internal approvals (Value Analysis, Medical Executive Committee, Board) f) Managing stakeholder communication and change management g) Monitoring post-implementation outcomes and contract compliance 4. All pricing data used within the Platform must be sourced from your organization's own records, GPO contract files, vendor quotes, or accounts payable data. Hospital Focus CK is not authorized by any vendor or GPO to distribute proprietary pricing information. Savings estimates, ROI figures, payback multiples, and per-category percentage ranges displayed in the Platform or on our public marketing pages (including the ROI Calculator and Savings Estimator) represent typical, illustrative outcomes for the relevant category archetype; they are not predictions of your result, and the high end of any range is not a typical or expected outcome. They are calculated by applying methodology-derived percentage ranges to your organization's self-reported spend data, or to bed-count-based spend approximations drawn from published hospital cost-per-bed research. LIMITATION OF LIABILITY Hospital Focus LLC explicitly disclaims any liability for: financial loss, negative clinical outcomes, patient harm, program disqualifications, vendor disputes, regulatory penalties, or any other damages arising from your use of the Platform's strategic models, recommendations, or generated documents. Maximum liability is limited as set forth in the Terms of Service Section 8. 8. THIRD-PARTY INFORMATION The Platform and our marketing materials may reference third-party data sources and published research, including peer-reviewed studies of the management-consulting industry. Where we cite a specific study (for example, Bruch JD et al., JAMA, 2026), we describe only the study's published findings; any cost comparison, per-engagement figure, or savings differential we derive from such a study is our own calculation and is labeled as a Hospital Focus CK estimate, not a finding of the cited source. Hospital Focus CK is not affiliated with, endorsed by, or sponsored by JAMA, the American Medical Association, or any study author.
